Hardly Cheshire cheese as that is made in England so it was a copy.

The legal principle of a product name being specific to the place it was first made did not appear until the 20th Century and only applies if the National Government of its origin invokes it formally. I don't believe Britain has done that, yet. Even if they did it wouldn't apply to this case.
