You refer to DUI being related to driving a motor vehicle. However the U.K. law of 1872 related to "drunk while in charge of carriages, horses, cattle or steam engines." While steam powered taxis did exist in 1897, none of the articles I've seen indicate what type of Cab George Smith was in charge of. So as horse drawn cabs were the more common type in use at the time, it's quite possible that it wasn't a motor vehicle.
